It is important to us to protect your data, which is why we comply with the applicable data protection regulations, in particular the DSGVO (General Data Protection Regulation) and the DSG (Data Protection Act) when processing personal data.

 

Personal data is any information relating to an identified or identifiable natural person and to any other person in respect of whom such data may exist in accordance with the Austrian Data Protection Act 2018 and which enjoys special protection (e. g. name, address, telephone number, date of birth, e-mail address).

Collection, processing and use of personal data.

 

If you are interested in our apartment (this includes browsing our website) or book directly with us, you may provide us with the following data:

 

  • family name and first names 
  • e-mail address, telephone number
  • address
  • date of birth or age 
  • nationality 
  • identity card number
  • payment data (e. g. credit card data, account information, billing address)
  • necessary medical data and any special requirements
  • your preferences regarding accommodation
  • your questions/comments/wishes in connection with your stay
  • other data necessary for the fulfilment of the contract of you as the main traveller as well as of the persons travelling with you 
  • information about your surfing behaviour on the website
  • information about when you click on one of our advertisements, including those placed elsewhere on the internet
  • information about how you visit our website, including operating system, IP address, online identifiers and browser details

 

Personal information about fellow travellers

 

We use personal data you submit about other people who are travelling or planning to travel with you. By submitting personal data about others, you are ensuring that they consent to this and that you may submit the data. You should also ensure, where appropriate, that they are aware of how their personal data will be used by us.

 

Data processing

 

In order to make a booking, it is necessary to provide your contact details. This includes personal data such as first name, last name, date of birth and other data such as period of stay or number of persons. The data provided by you on our website or transmitted to us by booking portals, including any notes, are personal data and are processed and used by us to ensure the processing of the booking and the provision of the requested service.

 

We also use your data to provide you with relevant information at the time of booking or during your stay, as well as to request your feedback after your stay or to contact you occasionally.

 

In addition, your data will be passed on to persons or companies for the purpose of processing your booking, such as the regional tourism authority, Smoobu GmbH (software service provider for apartment management and booking processing) or service providers for payment processing. By booking accommodation, you automatically give us your consent for this.

 

The processing of your data is mandatory for the booking. If you do not provide us with this data or do not provide it in full, we may not be able to fulfil our contractual obligations to the tourist board in full and may therefore be in breach of the Tourism Act.

 

We will not sell your personal data to third parties.

 

Sharing personal data with authorities

 

If it is required by law to share your personal data (obligation to register), we will comply with this obligation in order to enable you to enjoy a carefree stay in our apartment. We may share the minimum necessary personal data with authorities if the law obliges us to do so or if we are legally permitted to do so.

 

Sharing privacy-related data with external service providers

 

We work with carefully selected providers who perform certain functions for you or us. For example, these are companies that help us with IT services, data storage and linking, marketing, market research, processing payment transactions and providing products and services.

 

We may need to share personal data in order to protect or defend our legal rights, which includes sharing personal data with third parties to prevent fraud and reduce non-payment risks, for example. We only share the minimum amount of personal data that enables our partners to provide their services to you and us.

 

Marketing with your consent

 

From time to time we may wish to send you offers and news about our services. For this we need your consent. We will always ask for your consent in writing in the apartment or online.

Rights with regard to the processing of your data

 

Right to information

You can request written confirmation from us at any time as to whether and to what extent we are processing your data. Please note that we can only provide you with information if you can identify yourself. 

 

Right of rectification

If we process personal data about you that is incomplete or incorrect, you can ask us to correct or complete it at any time.

 

Right to restriction of processing

You may request us to restrict the processing of your data if 

  • you dispute the accuracy of the data, for a period of time that allows us to verify the accuracy of the data;
  • the processing of the data is unlawful, but you object to erasure and request restriction of data use instead;
  • we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims, or
  • you have objected to the processing of the data.

 

Right to deletion

You may request us to erase your personal data if we process it unlawfully or if the processing disproportionately interferes with your legitimate interests of protection. Please note that there may be reasons that prevent immediate deletion, e.g. in the case of legally regulated retention obligations. 

 

Right of objection

If the processing of your personal data is based on a balance of interests (Art 6 (1) (f) DSGVO: legitimate interests), you have the right to object to the processing at any time on grounds relating to your particular situation. When exercising your right to object, we ask you to explain to us your reasons why we should not process your personal data as we have done. 

 

We will review the merits of the case and either stop or adapt the data processing or show you our compelling legitimate grounds and continue the data processing.

We will also continue to process data if it is for the purpose of asserting, exercising or defending legal claims. 

 

You can object to data processing for the purposes of direct advertising and data analysis at any time. In this case, we will cease data processing.

 

Right of revocation

If you have given us your consent for the processing of your personal data, you may revoke this consent at any time. Your revocation does not affect the lawfulness of the data processing carried out until the revocation. In order to exercise the aforementioned rights, you must inform us in person, by telephone or in writing. Please note that we can only provide you with information if you can identify yourself.

 

Right to complain

If you are of the opinion that the data processing violates applicable data protection law or that we violate your data protection rights, you also have the right to file a complaint with the supervisory authority. Please address your complaint to the Austrian Data Protection Authority.

 

Excessive use of rights 

If you exercise any of the above rights in a manifestly unfounded or particularly frequent manner, we may charge an appropriate processing fee.

 

Legal basis for the processing of personal data

 

We only use the data we hold with your consent or to initiate and implement a business relationship.

 

Where we need to process special categories of personal data, for example health data for medical reasons, we will only do so if one or more additional conditions apply: We have your explicit consent; it is necessary to protect your vital interests or those of another person and you are physically or legally unable to give consent; it is necessary to establish, assert or defend legal claims; it is necessary for reasons of substantial public interest.
